It is still in the beta stage.

I think if it ever gets to a fully functional stage there will be a subscription fee (still cheaper than having to buy all of the games on there).

It is mentioned in the video that they have set up links with different publishers that will support it, that is why not every game is on it, only certain ones, WoW, mariokart, apparently crysis is on there (and will lag like hell i will imagine ) so you know that blizzard, nintendo and crytek support it, but there isn't any valve games, ubisoft games etc on it, so they don't support it at the moment and aren't on. Becuase they have the support and go ahead from these developers and publishers, i'm going to say this is totally legal
