Default Problem with modem in laptop

I bought a used Compaq Presario 1245 on ebay. It's running Windows XP. When I got it this morning, I tried to get Earthlink set up on the computer and when it went to dial-up to Earthlink, it said the modem was not functioning. I only have dial-up, so this is a big problem.

I went to check the devices and it said "The device is disabled because the firmware of the device did not give it the required resources (code 29)" I went online to check out HP/Compaq's website and it said this happens when the computer is upgraded to XP and the solution is " Using the operating system that shipped with the computer or purchasing a newer modem (PCI 56K modem) to resolve the issue is recommended" It also said something about enabling the modem in the BIOS and to see the manual or something like that, but I don't have that information and I don't know how to do it.

I don't have the Windows 98 disk that came with the computer, or even the XP disk. I don't really know anything about replacing modems either.

Is there anything that I can do to get this laptop connected to the internet without spending a lot of money, or should I ask him for a refund? It's a shame because other than being a little slow, it was a nice laptop and I got it for a good price, but if I can't get online, it's of no use to me.
