bad hard drive ?

I think my hard drive went out. my system crashed and then would not reboot message came up to boot from disc so i tried that but sitll woud not boot

my other question is there a way to get the files off the bad HD and put on the new one

You could try the freezer trick... put the drive in a ziplock bag and put it in the freezer.

Get it nice and cold and then plug it in and see if it will spin up.
 
^ Multiple ziplock bags help to prevent condensation as well. Definitely leave it in overnight or longer though. Just don't drop it when you pull it out of the freezer :P
