Hard drive is failing, but i have no OS recovery disk

Does this mean when I order my new hard drive that I need to order the physical disk of Windows 8.1 to have the operating system again?
 
Make sure you have written down the product key. Win 8 and 8.1 are allowed to be moved to other PC/Hard drive, as long as in use on only one PC at a time.

Unless you bought Windows 8 there is no product key. It's installed in the BIOS on OEM machines so there is no need to know what the key is.
