New sata 2 maxtor 160GB hard drive coming tomorow - i would like to get windows onto it from my old hard drive if possible.

How would i do this? Can i just plug in the new hard drive get into windows and then just copy and paste the files or would this not work?

No, you can't just copy and paste the info. If you got a retail drive, it should have the software to do so. If not, Maxtor should provide such software on their website to make a direct copy of your drive. If not, something like Norton Ghost would do the trick. Eh, sorry, I don't know of a free substitute...

Since im transferring from IDE to sata 300 would i see better performance if i was to do a clean install or would transferring my current windows run as fast as a clean install

You will typically see a performace increase anytime you reinstall windows; just from it getting bloated and fragmented over time. Just because you installed on an IDE drive shouldn't make a difference.

However, there could be some driver issues when going from an IDE to SATA install...
