SoftV92 Data fax modem with smart cp problem

My dad has a Emachine (T3828) and it has a SoftV92 Data fax 56K modem with smart cp.

The problem is that the modem WILL NOT transmit higher than 28.8K. (And YES, I HAVE gone through ALL the modem options in controle panel)

Has anyone had this kind of problem with Emachine modems? I am pretty sure that I need to replace it. I can't even get any support from Emachines or a driver for it.

Any problems reported with this modem?

Just so that you have some sort of response, I have not heard anything about this issue. However, I really don't pay attention to dial-up hardware or settings at all anymore..., sorry... Have you tried checking with the limitations of your phone lines or ISP?
