WD My Passport: data loss [NEED HELP]

We all know that data loss is a natural part of life, this is why we have back ups. However, when I first bought my WD Passport ultra, I was so excited downloading and moving software to it that I never really thought about data backing. In fact I was even so careless with my external hard drive I took with me every where I went, risking physical damage. After about, id say 2 months of heavy use of the thing I started getting this message:

and if i clicked on that message it would send me here:

Now this was all good because I was still able to use my files and everything, it was just a dumb message that I anticipated closing prior to every use. In hind sight if I had switched my data over the first time I got this message I would not be writing this terrible cry for help. To make a long story short I think im screwed by need some more opinions.

Now here is my scenerio at the moment:
When I plug in my external hardrive it actually appears on the computer like so:

in fact, if I click on it after about 1-3 minutes of loading, it will finally open and I can see my files:

Now WD presented the suggestion to send it to geek squad or any other respectable computer repair service that offers data recovery but:

1.) I do not want to risk them screwing it up past repair
2.) I dont know if the serviceit is worth the $150
3.) Most importantly in the event that I have cracked software on my harddrive I do not want to entertain the possibility of being arrested for it.

#3 is a serious fear. I actually went to geek squad yesterday and paid the $150, then read the contract and it clearly stated that pirated data as well as child pornography could result in them contacting the authorities. I immediately got my refund and went back home.

I am not going to admit, even on this forum, that I have cracked software, but lets be real, there is always a chance that someone could be arrested for possessing cracked software.

Anyways, what are my DO-It-YOURSELF options, and has anyone ever had an external hard drive containing cracked software serviced? The guy at geek squad said they dont look at the files, but the contract clearly said otherwise. PLus if someone had a file on their computer that said 'child porn' or something of that nature -that would grab their attention, would they not look in to it? Similarly if they see a suspicious file name hinting at piracy, or software illegitimacy on a hard drive being serviced they do have the right to do some snooping.

Anyways if you skimmed through this, tell me what you think. What are my options here? and bassed on the pictures, what is the condition of my hard drive?

Then what I suggest doing is, you said you can access your drive after a few minutes, start transferring your data to a different drive ASAP.

im sorry if I didnt say this before but I can SEE the data but I cannot use it. I believe the files are corupt or something. its a very weird thing If I click on a file and drag it it will just load for an infinite time.
 
Is it possible that you can remove the drive from the case and try hooking it up to your pc directly? If not, then you will have to pay to get your files back. External drives can go out at any time just like regular HDD's. Its always best if you have important data then use multiple backup media.

What do you mean directly? it is a usb hardrive
 
means hook it up directly inside the computer. hook up to motherboard. forget the usb.
see if it works then.
 
I understand that. But most external usb drives can be removed from its case and physically hooked up to a pc. Not sure if yours can or not.
