XP Legal question

Is it legal to buy a used copy of XP if the original owner installed Vista on his machine, and is there a link to a microsoft website to check the key to make sure its good?
 
if the copy of windows is oem then it will be tied to his mobo so when you install it you will proberly have trouble registering it and would have to ring microsoft,i am not sure if its illegal to buy second hand os but microsoft wont like it so i dont think it is a good idea.
