Computer wont power down

OK, here it is. I'm on my wits end.
The computer wont shut down running windows 7, it looks like its shutting down but then the screen goes black, the HD turns off but the fans keep turning and the LEDs stay on. Here is my build: (the computer is new and just put together)

Try a different power supply first. If that don't solve it then it's a motherboard issue, see if there is a bios update for it.

There is an update, I am not sure if this is the reason though; how would you find out?
I also have never updated bios, can anyone recommend a good site?
My bios is v4.0
