Yes it did show up when i first tried installing xp, but I can't remember what I did with it. I also have no idea how to get back to it. Everytime I re-start my computer it goes right back to the 39 minutes point during installatin and then the error message shows up.
Re: Partitioning...
Start the install process over again, and take it step-by-step. When you get to the part that mentions partitioning, you'll see a list of options. My advice is to delete every partition that show up, no matter how many there are. I forget the exact wording of the instructions, but IIRC, it's 'L' to delete, 'C' to create, and 'Enter' to install XP to the current selected partition. Just hit 'L' for each partition listed and follow the confirmation on the next screen. Do this for each partition. Make sure you take any files you may need off the drive first. By deleting every partition, you'll have one blank, non-formatted disk. I'd recommend making at least 2 partitions after everything has been wiped clean: maybe a 20 GB for Windows and Software, and whatever you have left for your files. That way, even if you have to reinstall XP in the future, you'll still have your personal stuff.

Does the CD have and smudges or scratches on it that could casue it to not read correctly?

39 minutes into the Install? Or 39 minutes remaining in the Install? Better way to ask it (sorry I didn't put it this way at first) is at what part is it freezing? Gathering data, Copying files, installing hardware devices, etc.?
