a good deal?

a guy is selling an AMD X2 3800+ for $200 and i'd really like it...

it's brand new (1.5 weeks old) and i'm wondering on whether or not it's been overclocked... i'm thinking a processor that cheap had to be used in some way or another to be selling that low... but i've asked the guy and he denies it...

he says that he's selling it so cheap because he upgraded to a X2 4800+ and must get rid of it...

should i buy it? also what is RMAing a CPU??? one of my friends say i could do it to get a brand new processor...

The going price for a new X2 3800+ is ~$300 so if the cpu in perfectly working condition $200 a good deal.
