Cannot be refunded for my PC...

Hello there,

I live in the UK and bought a PC from Cube247. However, I am unhappy with the product. It does not work properly at all and I do not like it in general. I would like to be refunded and send the system back but they would not allow me to do so. I customised the PC on their website and they claim that this is the reason I cannot be refunded for it. It says it under their terms on point C.2 which is found here http://www.cube247.co.uk/?page=terms

I was wondering whether this is acceptable? I read the terms but I apparently did not realise this as I find it normal that when you buy something you are not happy with at all you can be refunded? I know it might be possible to repair the system but I simply want to return it and buy from somewhere else. It would be nice if you could give me some advice on what to do. Thank you

Philip

If they say it cant be returned then what makes you think you can convince them to take it back? If you customized it yourself then that means they have to either wait a while for another buyer to want that exact setup, or go through the labor of "uncustomizing" it.

what dont you like about it? You can buy replacement parts for whatever it is you dont like and then sell the replaced stuff on places like here and ebay.

If your reason is "I don't like it" then the seller is under no obligation at all to refund your money. High street stores will exchange goods or give credit notes for good customer relations under these circumstances but again they do not have to.

If it does'nt work as expected or has a fault then within 7 days you can expect a full refund, after that period they will offer you a repair or exchange.

Software is a different matter where once the packaging has been opened, normally they will not accept it back as it could have been copied.

Irrespective of whether it was "custom built" or not if your sole reason for returning it is a fault then they must offer a repair or exchange.

But the PC regularly freezes for no reason and I had to push the reboot button quite often so far. Now it would not even start anymore. I thought when someone sells something which does not work one should be able to get his money back.

So how long have you had it and did it start playing up from day one, if it did, did you notify them.
Also have you installed anything as it may be a software problem not hardware.

Well I have it since Friday and I phoned them up yesterday and today but they claim they cannot refund it because it was customised. They do offer to repair it. However, by now I read many negative reviews about the company and I feel very uneasy about waiting up until a point where I cannot get my money back anymore.
For example, at one point I plugged in my headphones the system freezed. The only thing I installed was a computer game called Oblivion and it regularly freezes, although I have a nVidia GeForce 9800 GT 1024MB. This should not happen I believe.

Yea it sounds like the computer might be defective. At that point, they should offer to fix it, replace it, or give you a refund. Customized or not, it should work. Most of everyone's computers on here are custom and they work fine. However, if the company has a clause stating otherwise, then there's really nothing you can do.

A bit of a grey area this one as it could be software related or hardware. As you have installed "Oblivion" they could argue the install did not go right but would be willing to take it back to check it over.

I would put my complaint in writing as proof that it is not working as expected within the "cooling off" period of 7 days quoting this -

Wherever goods are bought they must "conform to contract". This means they must be as described, fit for purpose and of satisfactory quality (i.e. not inherently faulty at the time of sale

some good advice there dude

Fairs fair sorry but you brought a product that you just dont like thats your fault some would argue and say you may of used it for your use and now just want you money back. it may not be the case but it is allways what the company thinks

at my work we allow refunds under certain conditions
1.The Products in resell able cond
2.Has not had for more then a week
3.The packaging is not damaged (if it is we have the right to charge you 10%)
4.If you don't walk in and treat us like scum

Sorry, but I find it unacceptable. If you got it and it doesn't work right, you should be able to send it back.

He saying its because he don't want it
if there something wrong with it sure send it back but he just doesnt like it that like refunding something because you don't like the color

I clearly wrote that there are serious problems with the system. At present I cannot even boot the PC. Why would you say I am saying it because I do not want it?

Doesnt really matter what anybody on this forum thinks. From the contract, your not getting your money back, its a custom built plus opened, like it or not. Your best bet is to return it for repair. Simple as that!

hi there are quite a few good replies there with regards to the product not conforming etc. Take a look at this site

http://www.oft.gov.uk/advice_and_resources/resource_base/legal/distance-selling-regulations/

sorry im unsure of how to do a link. Goods sold under the distance selling act have a 7day cooling off period. I would presume your item would fall under this bracket if brought from the internet or phone. read the regulations or phone the office of fair trading for a definate answer. i think you may be entitled to a full refund under this. but check with them..

This is a very open and shut case. They sold you a product so both parties entered into a contract. They have not upheld their end of the contract because the product does not work; you have because you paid them. They are obligated to refund your money or repair the product. Anyone that tells you otherwise doesn't know contract law.
