Cyber spying - need help

My ex husband is a computer geek who makes life awful. I was suspicious he was spying on me through my computer that runs XP os. I took it in and sure enough there was a log-in/log-out register still in the bowels of the thing where he had been looking at all my banking, documents, and medical stuff. I bought a Vista os and now he is calling my work trying to find out my new email address so he can "get inside" this one. What can I do and how can I prove it is he who is spying on me? I wish the first time he tried to log onto my computer, his computer would fry! Help! If I could prove it, I think I could take him to court but I'm not sure how that works.
 
if you did a clean install (formatted the hard drive before installing vista) and have any decent antivirus software installed, he isn't going to be getting into your computer. There are may ways someone can get into someone elses computer, and not knowing how he was doing it would make catching him harder, but I would also change any passwords you have since many spy programs allow you to capture keystrokes and steal screen shots. Once you do that you will be about as safe as you can expect unless you want to go as far as disconnecting the internet whenever you leave the computer. Proving anything is going to be quite hard, and I would reccomend that you just cut your losses and just prevent any future spying.
 
With a clean format/reinstall like jjb said its gonna be difficult for him to access your computer again, especially if you have an up to date firewall/anti virus and are behind a NAT router. if you want to prove anything you could set up monitoring/logging on your router but actually making sense the of the logs would require a bit more technical knowledge.
