Did I buy a fried CPU?

I am upgrading my old PC for my wife. I am currently running an AMD XP 2000+ and purchased a pulled AMD XP 2700+ off eBay. I am using an MSI KT4V-L (bios v. 1.7) Mobo. The website states that this bios supports the 2700+ CPU. When I plug the new CPU in, and press the power button, the harddrive light comes on and stays solid for about 10 seconds, then nothing happens. Nothing ever shows up on the screen. Should I flash my bios, or is it not worth attempting anything else because I bought a dud CPU?
 
Try resetting CMOS.
What was the feedback rating of the Ebay seller? Does he offer refunds or insure a non-DOA product?

I'm picky about using Ebay for that stuff. Granted, I occasional sell old parts there, but I list honestly and test before listing and again before shipping if possible. I know not everyone does that, though, and sometimes if they don't say guaranteed not DOA, they'll be pricks about it.
 
No funky smell. The eBay seller claims he doesn't check the CPU's and offers no refund. All his feedback (12) is very positive, with working CPU's reported. It was only $12 shipped, so I took a risk. I tried resetting the CMOS already, and that does not do it.
 
Heatsink is always on when I turn on my PC. No blackness or bad smell whatsoever. I will try flashing my bios. First time, wish me luck.
 
I dont know about anyone else, but I would be leary buying something like that from a seller with only a 12 feedback rating...
 
I only have +/- 20-ish and all my stuff is legit. It all depends on the integrity of the person selling, Feedback is only an afterthought.
 
I just contacted the guy, and he is now sending me a new one for half price. Anyone want to buy an AMD Athlon XP 2700+? I can't guarantee that it will work...
