iPOD mini question

A woman whom I work with got an iPod for her daughter for Christmas. She bought it from her niece who had around 200 songs on it. She kept the songs on it and gave it to her daughter. When she tries to add songs to it, it tells her she must delete the ones already there. Her daughter wants to add songs to it but doesn't want to delete the songs on it already. I know little about mp3 players so here I am. Can she just add songs to the iPod or does she have to delete the existing songs?
 
alright, she got them out with idump..they won't play in itunes because they're mpeg-4 which I told her is fine. Can she now delete the files from her ipod? Once she does, can she just add the mpeg-4 files and some mp3's at the same time?

also, do the mp3's just get converted to mpeg-4's when transferring to the ipod?
