New built not powering up. Must be mobo?

Gigabyte Ep45-ud3r And intel duo core 2 e8400. Got the rig together and fired it up... nothing. Tried switching power supplies. No help. Tried switching soft power buttons nothing. Tried different power cable. Still dead. At one point it actually fired up but after I turned it off it wouldn't happen again. There is no power response, no fans, nothing. This has to be a mobo issue right?

Check for loose connections, try hooking up motherboard outside the case to make sure its not grounding against anything. Try using only one memory stick, video card, keyboard and mouse. Might have fualty hardware somewhere.

Check that your front panel connections (Power switch, HDD led and power led) are all in their proper spaces. older cases and newer motherboards (or vice versa) tend to have different colour codes for these things. My power button lead is blue but it goes into the red spot on the motherboard.
Try just getting the power switch in the right position then add others one at a time

So it won't power up under any circumstances. I've tried all things mentioned. My epox board fires up in this case with this PSU. I think the only thing left to do is RMA the Gigabyte board and try a new one

Yes, go ahead and do it.
I recently got my mobo replaced because of a dead BIOS. I looked at the bios chip prior to sending it back. When i got it back, the bios chip had a mark on it from a marker. they claimed that the board was not faulty. strange thing was, when i booted it up the first time everything worked great and i got windows installed along with a few apps. shut it down, do some stuff, come back and turn it on and it wouldnt work.
