Phenom 9550 Warranty Question

I am looking at buying a used Phenom 9550 Quad-Core (2.2 gigahertz) processor. This processor was pulled from a working system and is in fully functional condition.

The release date on the Phenom 9550 processors was the year 2008 correct? Would the manufacturer warranty cover this item out until the year 2011 even though I am not the original owner of it? I don't plan on doing any overclocking with this processor. I am going to run it at a 2.2 gigahertz speed.
 
3 years on a retail CPUs. If it was pulled from a OEM or was bought as a OEM is has no warranty other then a 30 day from who ever it was bought from.
 
The processor was pulled from an original equipment manufacturer. It has a 15 day defective on arrival warranty. The retail version model number is HD9550WCGHBOX. This processor model number is HD9550WCJ4BGH.

From my knowledge there isn't any difference on the retail model and the original equipment manufacturer version other than the model number is there? The Phenom 9550 works with my motherboard and BIOS version. The Phenom 9550 model number is HD9550WCJ4BGH. This processor will work with my Gigabyte GA-M78SM-S2H motherboard correct?
