Whichever vista designer had the bright idea to have a delete button, as well as an empty button, listed when you right click the recycle bin should be shot. You don't know how many times I've clicked delete instead of empty and then had to get it back on the desktop.

Recent reports have confirmed that the man has indeed been shot. In memory of this tragic event, Microsoft has decided to keep the Delete button in the recycle-bin's right-click menu.

If you don't want to empty the recycle bin, than delete the files permanently. Hold Shift while selecting Delete in the right click menu or while pressing the Delete key instead of just Delete.
This way you will throw the files away without moving them to the recycle bin. Careful because you won't be able to recover them again.
