Recycling bin PROBLEM

The bin icon has paper in it but when i click on it nothing is inside, when i right click to empty it, it asks me if i want to delete 'WINDOWS'. I already have hidden files shown and CCleaner isn't emptying it either..
 
Create a file in notepad and save it, then delete it, empty recycle bin and see if its ok then.

Did as you said, nothing has changed. It managed to remove the notepad but now still says 'WINDOWS' is in it when I try to empty it.
 
I had this problem on my old computer, just disable the recycling bin and restart, then enable it again and restart. I was using vista so here are the steps I used:

Click on "Start" and type "gpedit.msc" (without quotes) in the Search box.

Click on the "gpedit.msc" program in the search results. This will open your group policy editor.

Click on "User Configuration > Administrative Templates > Desktop."

Scroll through the list on the right-hand pane until you see "Remove Recycle Bin from Desktop." Right-click on it and select "Edit."

Look under the "Remove Recycle Bin Icon from desktop" options. Click the box that says "Enabled." This will enable the group policy to prevent the icon from displaying. Restart your computer for the change to take effect.

After trying as mentioned my question did you try to take back to an earlier date before this took place?
 
this does actually happen to me as well

i reinstalled windows (not because of the recycling bin) and the hidden windows folder has gone

it is weird how it happens
