So I took Vista off the laptop..

Interesting, didn't exactly read the EULA. So if you were to say scratch your Vista disc, you'd have to flat out buy another one, even though your key is still valid? Stupid Microsoft... I think it's safe to say when my disc gets munged up I won't be running out to buy another copy.

No, but you can make images and back ups of your original disc that can be used in its place.

yes, you are suppose to legally buy a new version if your disc gets damage, there is no warranty with Windows itself other than a 30 day period where you can return it if you don't like the product.

It is your responsibility to take care of it or at least make back ups of it.

I guess theoretically you would, but IMO as long as you have a legitimate CD Key, I see no reason why if something happens to your original disc why you can't use another copy of Windows, as you aren't actually taking anything that you didn't pay for.

Exactly my view. Your paying for the key more than anything, and as long as you have that key it doesn't matter which disc your using. If backing up your disc is legal, then that should be as well, since the information on the disc is exactly the same.

It doesn't matter how you view it, it matters how Microsoft's lawyers view it and they have a lot more lawyers than you do.

While, I think the EULA is a bit ridiculous myself, I wouldn't give out advice to someone that tells them to just go download it because they own a serial number to the product. That could end up getting them in trouble.
