well, i live in maryland and the residential comcast internet is only supposed to go up to about 5 mbps and when i use the bearshare pro client, i will pull speeds of up to 8-9mbps. why does it go this high if they limit it?

Sounds like a program error, since you cant download faster then your rated internet speed. Go to www.speakeas.net/speedtest and see what connection you really have.

Cable is NOTORIOUS for this. Pay for a 3mbps connection, and be able to pull stuff at 5, 7, rarely over 8mbps at times. It's all dependant on who is on your grid, what they are downloading, and how many of them are there. When my family lived here in Oskaloosa and had cable here when it first came out, we had a 3mb/256kb connection that we would peg 9mb/~320kb on. We were also for some reason the only early adopters really. Then eventually more people came onto cable in our section and we slowly watched our actual speed dwindle to about 5mbps.
The problem with cable is that it can theoreticaly perform as slow as dialup or an isdn line, something like that. Problem with it is that it shares the bandwidth overall, while dsl is a single line right to you. So when nobody else shares, you get a crapload. When everybody else is on, its like a university network - clogged!
They do have a "guaranteed" rate though, at least I've always been told this. You'll have to look into your specific ISP's policy. If you pay for a 3Mbps line, you're not going to get exactly 3Mbps or higher ALL the time. But of course, they can't provide you with 56kbps and tell you "Oh, it's because your whole neighborhood is online right now. Sorry, there is nothing we can do." Unles of course, your ISP has no kind of guarantee as far as minimum connection speed.
