Since there has been a bit of a mixed reaction to the original thread posted here by lynx6200, i decided to make a poll so it is easier to view peoples views.

Vote for either:
The Customer who hands the illegal disc to the retailer,
The Retailer who installs the Windows copy,
or Anybody else you can think of.

perhaps you misinterpreted my comments back in that thread. I wasn't expressing my opinion i was expressing fact. I wasn't saying this is what i think would happen, i was saying this is what will happen

Its all a matter of what you are aware of. Did you customer know it was illegal, did the installer (vendor as i will call it) know it was illegal. This is benched mark against what is called "the reasonable man test". This is to say, if you were to take another vendor of similar competency and place him in the same circumstances, would he reasonably be expected to know it was illegal.
Same goes for the customer, given another customer of similar competency would he reasonably be expected to know that the material was illegal.

Blame could be ascribed to one, both, or neither of the parties
 
I do see what you are saying, but i was placing this poll so people can poll on what they THINK should happen. It doesn't necessarily have to be what will happen.

I've just voted the customer who hands it to the person who is installing it, although after thinking about it i'm not sure. I think the customer is in the wrong for having an illegal copy of windows in the first place, although if the installer also knows it is illegal then they are accepting the illegal activites of the customer, although if the installer does inform the customer that it is illegal then possibly it should be the customer to blame.

Hmm, i'm not really to sure now!
 
I vote the retailer.

How is the customer meant to know if the installation is legal or not? The retailer would know if the installation they performed was illegal though, I think (unless they recieved the disc from someone else, in which case it's the supplier's fault).

However, if the customer finds out it is illegal and does nothing about it, it is also the customers problem.

If I unknowingly bought a computer with an illegal installation of XP on it - I would ask for a refund.

microsoft isnt even the worlds largest company. i think walmart or mcdonalds is......the only reason it gets so much attention is because bill gates pinned himself with a huge salary.

The apple founders would be responsable because they invented the graphic user interface that Bill Gates stole in the first place. Incidentally MS is the biggest patent infringer in history.
