I have swapped the hard-drive from one of my pc's to the other( I was having a problem with one....but that is another matter). Does this infringe the windows O/S license? I ask this as I have had a problem since I accessed the Microsoft website to download an update. Can Microsoft detect if you have changed your pc spec? If so what action can they take? Please help if anyone can shed any light on this.
 
It should not matter that you have changed your hdd to one computer to another. You paid for the os. If you have more problems call them up.
 
If you have an OEM version it is illegal. Meaning, if you bought this on a computer that had windows pre installed, an a recovery CD, then that is illegal, or if you bought an OEM verison of windows.
If you bought a retail copy, and put it on your custom machine, you can move it, just you'll have to re-activate it.
 
According to their website an O/S cannot be transferred from one computer to another. It quotes "an OEM O/S licence lives and dies with a pc....it is not transferable". So I guess that means if you transfer the hard drive that contains the O/S to another computer(even if you own both pc's) then it is illegal. QUESTION: Do Microsoft have the ability to detect this and can they take action if you are connected to their website? :)
 
If it's retail, it can, just that OEM versions can't. And it's illegal, and it will ask you to reactivate, you'll fail activation, and Windows will lock after 30 days, sad reality, there is no work around. You're always connected to MS, especially if you retrieve updates.

windows locks after 30 days? i know someone with "illegal" copy and never had that problem, the auto updates work fine too

Yes, retail copies will not log in after 30 days until activated. What your friend pirated, which is what all pirates do, is got a Corporate version. These are pre activated copies through VLK licensed to corporations. Auto updates will work fine, but if he goes to connect to Windows update, validation will fail. Microsoft has said they will allow illegal versions to recieve automatic critial updates, via the background client, but nothing related to the site version. Same goes with vista, but pirated versions won't run Aeroglass.
